Patentability/Novelty Searches:
Patentability/Novelty Search Report enables the Inventor(s) to identify whether the Invention (in view of the Inventor) is really an Invention? Or does any similar invention exist?
A "novelty search" is a prior art search that is often conducted before an inventor files a patent application. A novelty search helps an inventor to determine if the invention is novel and if similar prior art exists; the report enables the inventor for alternative approaches to obtain a patent. The search includes searching in databases of patents, patent applications and other documents such as utility models and in the scientific literature.
Our highly qualified and trained technical specialists’ with sophisticated and advanced search database and tools enable us to identify similar or close prior art related to the invention, thereby enabling the Inventor(s)/ Attorneys/ Agents to:
- Broaden or narrow the scope of the Invention based on identified prior art.
- Cite references in terms of advantages of the Invention to the existing art.
- Avoid infringement. etc.
- To convince investors for providing sufficient funding.
Prior Art Searches/ State of the Art Search:
A Prior Art search/ State of the Art report provides an overall view of a particular given technology, its latest developments. This repost assists Inventors/ Researchers to identify prior art close to their invention. This report facilitates Inventors/ Researchers to closely study features of existing prior art at micro level and modify existing invention with intellectual anticipation for future needs/ requirements/ developments and design around.
This report facilitates to understand the technology trend in the recent past and business planning or product programming. It also helps you plan your R&D initiatives when starting new businesses or developing new products/ processes. We understand the importance of knowing exactly, the client’s needs and provide relevant patents. The true and exact value for his investment is guaranteed, as our regular daily/weekly interaction with the client will allow us to picks patents representative of a specific technology, but does not cite every patent having to do with the technology, as there would be a great deal of redundancy. However, sometimes a client may want each and every patent on a given technology. This type of search is more properly called a Collection Search, but the terms are often used interchangeably
Our Well qualified and experienced domain expertise would analyze the relevant prior art for the features desired and excellently reproduce the report in the format compatible to the Inventors/ Researchers for quick review/ analyze and organize according their core development areas.
Validity/ Invalidation Searches:
Validity/ Invalidity searches are conducted on issued patents and sometimes for patent applications as well. Patent Office may have issued the patent (or allowed specific claims contained in the patent) after conducting a thorough search, but still there lies a scope of a marginal error in determining relevant prior art. A Validity search report provides all relevant prior art that are not cited by the examiner, yet potentially reads on the claims and valid enough to challenge the issued patent. Similarly, when a company has made a product that infringes upon another company's patent, and they are being sued as a result. One way to win an Infringement case is to invalidate the patent in question. If a patent search can locate prior art that reads on the claims of the patent in question, those claims will be struck from the patent. The patent owner then loses his legal right to sue over products that would infringe on those claims.
Usually Validity search is carried out for:
- Legal opinion against infringement
- Due diligence prior to selling or license a patent
- Practice technology without paying royalties, if invalidated.
Our Search specialists are well experienced in Invalidation and most successful in identifying relevant prior-art before the priority date of the invention for invalidation.
Freedom-to-operate search or Infringement search:
Freedom to Operate (FTO) (also known as Right to Use, or Clearance search) is a Comprehensive search conducted on issued patents and pending applications to determine, whether interested product or process infringes any of the claims of the issued patents or pending patent applications.
Our focus for FTO is to carefully examine the claims language of third-party in-force patents and is typically conducted as due diligence to assess the risk of potential infringement. Our Search specialists are well trained and experienced to prepare multiple search strategies in identification of relevant prior art, if exists. The reporting format is well structured to easily understand the correlating features in the claims and enhance the quality of subject matter interpretation.
Citation Analysis/ Mapping:
Citation Analysis is an intelligence survey for identifying competitors, citing a particular patented technology of interest and evaluates forthcoming competitor’s strategies in that technology and generate strong foolproof fence around the basic patent to generate optimum protection.
This analysis also enables the inventors to understand various other inventors’ activities in the same domain and protect the possible design around of the patented technology.
This analysis also provides a clear overview of others citing this invention is genuine or infringing.
Patent Watch:
A Periodic tracking and updation of latest issued patents/ Publications in a particular technology of interest will enable to:
Be prepared for oppositions
Identify infringements.
To know latest modifications to current technologies.
To track next strategic moves by a particular Inventor(s) or organizations.
At Acumen we keep track of patents/publications on weekly/monthly/quarterly basis.
Due Diligence Search:
Due Diligence Search is basically performed to understand the strength of the Invention and also evaluate future prediction in terms of financial gain/ risks / infringements etc.
Some examples of Due Diligence searches:
Pre-Litigation Due Diligence searches
Merger & Acquisition Due Diligence Search
Due Diligence Search – Before Licensing
